Chihuahua Puppy Contract and Terms of Sale
These are the terms every family agrees to when buying a Chihuahua puppy from Diamond Chihuahuas, plus the general terms for using this website. We send the signed contract before pickup so you can read it at home first.
"We", "us" and "our" mean Diamond Chihuahuas, a family Chihuahua breeder in Temple, Texas. "You" and "buyer" mean the person who signs the puppy contract. The signed contract is the agreement that governs your purchase; this page summarizes it. If the two ever differ, the signed contract controls.
Pet-Only Placement
All puppies are sold as companion pets only, without breeding rights. You agree not to breed the dog, sell its offspring, or register any litter it produces. Breeding rights are not offered through this website.
Spay and Neuter Requirement
You agree to have your puppy spayed or neutered by 12 months of age, or by a later age your vet recommends in writing for a toy breed, and to send us proof from the clinic within 30 days of the surgery. We give this window on purpose: very small Chihuahuas are often safer under anesthesia once they reach a steady adult weight, so talk to your vet about timing rather than booking the earliest date.
Registration Papers
Puppies are eligible for registration with the AKC on limited (non-breeding) registration. We complete the litter registration and give you the individual puppy application at pickup. You are responsible for submitting it and paying the registry's fee. Registration records parentage only; it is not a guarantee of health or quality.
Adult Size and Weight Are Estimates
Any size tier, projected adult weight or size range we give for a puppy, including our Teacup (3 to 4 lbs) and Toy (4 to 6 lbs) tiers, is an estimate based on the parents' adult weights, earlier litters and the puppy's growth so far. It is not a guarantee. A puppy may finish larger or smaller than projected, and a difference in adult size or weight is not grounds for a refund, return or replacement under this contract or the health guarantee. We will never promise an adult weight under 2 pounds.
Our Return and Rehoming Clause
If at any point in your dog's life you cannot keep it, you agree to contact us first and return the dog to us. You agree never to surrender it to a shelter, rescue, auction or pet store, and never to sell or give it away without our written approval. We will take the dog back at any age.
Returns are not a refund. Any money paid for a returned adult dog is at our discretion. If a new home is approved by us, the new owner must agree to these same terms.
Buyer Responsibilities
- Take the puppy to a licensed vet within the window set in our health guarantee.
- Provide food, clean water, shelter, warmth and routine veterinary care for the dog's whole life.
- Keep the dog indoors as a family pet, never kept outside or in a kennel run as its main home.
- Keep the microchip registration in your name with current contact details.
- Pay the balance and any agreed delivery cost as set out in our deposit and refund policy.
- Tell us if you move or change your phone number, so we can reach you about health updates in the dog's family line.
Limitation of Liability
Our total liability for any claim relating to a puppy is limited to the purchase price paid for that puppy. We are not responsible for veterinary bills, emergency care, travel costs, or any indirect or consequential loss, except where Texas law does not allow this limit. Your remedies for health problems are those listed in the health guarantee. Puppies are living animals; we describe temperament, coat and expected adult size honestly, but we cannot guarantee a specific adult weight, color change or personality.
Governing Law
This contract is governed by the laws of the State of Texas. Any dispute will be handled in the courts of Bell County, Texas. Some states have puppy lemon laws that give buyers additional rights; nothing in this contract removes rights you have under the law of Texas.
